Agreement Overview
These Terms of Service, End-User License Agreement, and Privacy Policy apply to SapphireXR, including the SapphireXR website at sapphirexr.com, the SapphireXR client, account services, creator tools, event tools, uploaded content, and related online services operated by Freelight Labs.
This page has been updated for the current SapphireXR name, domain, product structure, and contact information.
By accessing, installing, downloading, possessing, or using SapphireXR, you agree to these terms. If you are using SapphireXR on behalf of a company or other entity, you represent that you have authority to bind that entity to these terms.
Some SapphireXR features may be alpha, beta, experimental, or otherwise pre-release. Those features may contain bugs, crashes, interruptions, data loss, content loss, or other defects. Use pre-release features only if you accept those risks.
Terms Of Service
1. Acceptance Of Terms
By accessing or using SapphireXR, you agree to comply with and be bound by these terms. If you do not agree, do not use the platform.
2. Accounts And Security
You may need an account to use certain SapphireXR features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify SapphireXR promptly of any unauthorized access, suspected breach, or misuse of your account.
3. Eligibility
SapphireXR is not intended for children under 13. By using SapphireXR, you represent that you are at least 13 years old. If a parent or guardian believes a child under 13 has provided personal information to SapphireXR, they should contact us so we can review and remove the information where appropriate.
4. Platform Changes
SapphireXR may add, modify, suspend, or discontinue features, services, content, tools, access levels, or platform rules at any time. We may also update these terms when platform features, business practices, or legal requirements change. Continued use after an update means you accept the updated terms.
End-User License Agreement
5. Software License
Subject to these terms, Freelight Labs grants you a limited, revocable, non-exclusive, non-transferable license to install and use the SapphireXR client and related tools for personal or authorized business use with SapphireXR services.
6. Restrictions
You may not copy, sell, rent, lease, sublicense, distribute, reverse engineer, decompile, modify, bypass security controls, interfere with platform operation, scrape private platform data, or use SapphireXR for unlawful purposes except where applicable law expressly permits otherwise.
7. Ownership
Freelight Labs retains all rights, title, and interest in SapphireXR software, web applications, systems, platform technology, branding, and related services. No rights are granted except as expressly stated in these terms.
8. No Warranty
SapphireXR is provided on an "as is" and "as available" basis. Freelight Labs does not warrant that the platform will be uninterrupted, error-free, secure, compatible with every system, or free from data loss or defects. You accept the risks associated with using the platform.
User Content
9. Ownership Of User Content
SapphireXR may allow users to upload, create, configure, publish, or share scenes, worlds, avatars, scripts, media, names, descriptions, branding, event information, and other content. You retain ownership of content you own, subject to the license below and any rights held by third parties.
10. License To Operate The Platform
By uploading or publishing content to SapphireXR, you grant Freelight Labs a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, perform, transmit, modify for technical operation, and make that content available according to your selected platform settings. Public worlds, public avatars, public events, or other public listings may be accessible to other users.
11. Content Responsibility
You are solely responsible for the content you upload or make available through SapphireXR. You represent that you have the legal rights, licenses, consents, permissions, and releases required to upload, display, perform, stream, or otherwise use that content on the platform.
12. Prohibited Content
Do not upload or share content that is unlawful, infringing, deceptive, malicious, exploitative, harassing, hateful, threatening, invasive of privacy, sexually exploitative, or otherwise harmful. Do not upload copyrighted material, trademarks, likenesses, music, video, audio, software, or other protected content unless you have the necessary rights.
13. Moderation
SapphireXR may remove, restrict, hide, disable, or preserve content at any time if we believe it violates these terms, creates legal or safety risk, harms platform operation, or is otherwise inappropriate for the service. Accounts associated with violations may be limited, suspended, or banned.
Events, Payments, And Commercial Use
14. Events
SapphireXR may allow users to create free or paid events, public worlds, private worlds, and related listings. Event features, upload limits, access levels, pricing tools, and account types may change over time.
15. Paid Events And Ticketing
Paid event hosting, ticket sales, commercial use, revenue share, payout timing, transaction fees, refunds, chargebacks, and related obligations may require a separate written agreement with Freelight Labs. Unless we expressly authorize otherwise, tickets to events hosted on SapphireXR may not be sold outside approved SapphireXR ticketing or payment systems.
16. Refunds And Chargebacks
Refund availability depends on the event, payment processor, applicable law, and any separate commercial agreement. Contact support before initiating a chargeback so we can review the issue. Improper or fraudulent chargebacks may result in account restrictions, fees, or loss of access where permitted by law.
17. Payment Processors
Payments may be processed by third-party payment providers. Those providers may collect and process payment information under their own terms and privacy policies. SapphireXR does not control third-party payment processor policies.
Conduct, Safety, And Access
18. User Conduct
Users must treat others with respect and may not harass, threaten, impersonate, defraud, exploit, stalk, dox, disrupt, spam, or abuse other users, staff, systems, or communities. SapphireXR may ban users, accounts, devices, IP addresses, payment methods, or other identifiers when needed to enforce these terms or protect the platform.
19. Adult Content
Content or experiences designated for adults may be restricted to private or age-gated spaces as determined by SapphireXR policy. Users who access adult-designated content affirm that they are at least 18 years old or the legal age of majority in their jurisdiction, whichever is higher. You are responsible for ensuring that adult content complies with applicable laws in your location and in the United States.
20. No Illegal Or Regulated Activity
You may not use SapphireXR for illegal gambling, unauthorized skill gaming, unlawful financial activity, exploitation, non-consensual intimate content, child sexual abuse material, malware, unauthorized surveillance, or any activity that violates applicable law or platform policy.
21. Limitation Of Liability
To the maximum extent permitted by law, Freelight Labs is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, platform interruption, content loss, or unauthorized access arising from your use of SapphireXR.
22. Governing Law
These terms and any dispute related to SapphireXR are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, unless applicable law requires otherwise.
Privacy Policy
23. Information We Collect
SapphireXR may collect information you provide directly, such as usernames, email addresses, passwords or password reset requests, account settings, uploaded content, world and event details, support requests, and communications with us.
SapphireXR may also collect technical and usage information, such as IP addresses, device identifiers, hardware and software information, log data, crash reports, authentication records, security events, cookies or similar technologies, pages visited, features used, and interactions with worlds, events, or uploaded content.
24. How We Use Information
We use information to provide, maintain, secure, troubleshoot, improve, and personalize SapphireXR; operate accounts and authentication; process support requests; enforce terms; investigate abuse; communicate with users; operate worlds, events, uploads, creator tools, and platform features; and comply with legal obligations.
25. Cookies And Similar Technologies
SapphireXR may use cookies, local storage, and similar technologies for login sessions, security, preferences, analytics, and platform operation. You can control some cookie settings through your browser, but disabling cookies may prevent some features from working.
26. Sharing Information
We may share information with service providers that help operate SapphireXR, such as hosting providers, email providers, analytics providers, fraud prevention services, payment processors, and support tools. We may also share information if required by law, to protect users or the platform, to enforce terms, or in connection with a business transfer such as a merger, acquisition, financing, or sale of assets.
27. User Choices And Controls
You may be able to update account information, adjust privacy or visibility settings, remove uploaded content, or request account assistance through SapphireXR tools or by contacting support. Some information may be retained when needed for security, legal compliance, dispute resolution, backups, or legitimate business operations.
28. Data Retention
We retain information for as long as needed to provide SapphireXR, maintain security, resolve disputes, comply with legal obligations, enforce agreements, and support business operations. We aim to keep sensitive information only as long as reasonably necessary for those purposes.
29. Security
We use administrative, technical, and organizational measures designed to protect user information. However, no internet transmission, storage system, or online service can be guaranteed to be completely secure.
30. Children's Privacy
SapphireXR is not directed to children under 13 and does not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without appropriate consent, we will take reasonable steps to delete it.
31. International Users
If you use SapphireXR from outside the United States, your information may be processed in the United States or other locations where our service providers operate. By using SapphireXR, you understand that your information may be transferred to and processed in those locations.
32. Privacy Policy Updates
We may update this Privacy Policy to reflect changes in our services, data practices, legal obligations, or business operations. Continued use of SapphireXR after an update means you accept the updated policy.

Any provision of these terms or this Privacy Policy that by its nature should survive account termination will survive termination, including ownership rights, licenses needed for platform operation, disclaimers, limitations of liability, payment obligations, and dispute provisions.
